La Policía detiene a Santiago Fuentes en Tenerife en una de sus casas, dedicado al mundo de las criptomonedas y dueño de Abistar, presunto autor de una estafa piramidal , pertenencia a organización criminal y blanqueo de capitales.y también registran otras tres viviendas de su propiedad
La investigación estaba abierta desde el pasado mes de septiembre, tras las demandas presentadas por algunos clientes ante lo que consideraban un presunto delito de estafa piramidal. El escándalo estallaba cuando el pasado 12 de septiembre, la empresa Arbistar 2.0 determinaba la cancelación de uno de los productos estrellas de la compañía, el llamado Community Bot, lo que implicaba que más de 32.000 familias no pudieran acceder a los ahorros en forma de bitcoins que habían depositado en productos de esa firma, una situación que afectaría como mínimo a inversiones por valor de 9,34 millones de euros, según había reconocido entonces la propia empresa.
Santiago Fuentes, en unas declaraciones explicaba que “una mala gestión hizo que cayera el Community Bot”se trataba “de un robot de arbitraje, un proceso informático que se encargaba de comprar barato (las criptomonedas) y venderlas caro de forma automática”.
En un primer momento, en Tenerife se habían registrado una decena de denuncias contra Arbistar 2.0, por valor de más de 300.000 euros, y otras cinco en la Península, en este caso por otros 100.000 euros presuntamente estafados, según los últimos datos que trascendieron de una investigación que se encontraba bajo secreto de sumario. El director de la firma, Santiago Fuentes, confirmaba entonces que “hay alrededor de unas 32.000 familias afectadas”, e insistía en que todo se debía a un “error informático”, defendiendo que en ningún momento habían pretendido “cerrar y desaparecer”.
Según la compañía Tulip Research, encargada de investigar operaciones de carácter fraudulento, en el caso de la empresa Arbistar 2.0 el volumen del engaño podría llegar a alcanzar los 850 millones de euros.
La elevada rentabilidad que se promete por la inversión en bitcoins es el mejor de los cebos para atraer a las víctimas de las llamadas estafas piramidales. En algunas ocasiones, los expertos en este tipo de temas señalan que el perfil más común de los afectados se acerca mucho al de un empresario que decide aventurarse a la inversión y lo suele hacer a título personal, pero con el grave inconveniente de no contar con asesoramiento por parte de expertos.
También el anonimato en las transacciones es otro de los elementos que provoca una enorme atracción hacia este tipo de productos, sobre todo para aquellas personas ligadas con actividades de narcotráfico o bien otro tipo de acciones relacionadas con la delincuencia organizada, y cuyo objetivo principal no es otro que el de blanquear sus ingresos.
El ejemplo de Fórex: Hace dos años, el Alto Tribunal acordó el decomiso de los bienes intervenidos y la disolución de Evolution Market Group, con sede en Panamá. En el citado caso también fue procesado Santiago Fuentes Jover, pero acabó absuelto. ¿Cuál era el papel de Fuentes en dicha actividad? Impartía las conferencias para captar nuevos clientes, que, a su vez, atraían a más inversores con la promesa de lograr una alta rentabilidad con sus depósitos; del 20 o del 40 por ciento cada mes. Muchas de las personas afectadas llevaron a la trampa a conocidos, amigos y familiares. La alerta de la Comisión Nacional del Mercado de Valores sobre Evolution Market y Finanzas Fórex se produjo cuando la trama creada por Germán Cardona y su pareja atraía a unos 600 clientes diarios. De ser ciertos los comentarios realizados por los denunciantes con los comportamientos actuales de Fuentes, lo ocurrido con Arbistar se asemeja a lo que pasó hace una década con Fórex.
Orador profesional: Santiago Fuentes se presenta como orador profesional, especializado en arbitraje de critpomonedas y CEO de Arbistar 2.0. La sede de esta última sociedad se halla en la puerta 7 de la quinta planta de la torre de oficinas del edificio Zentral Center, en Playa de las Américas, en el municipio de Arona. En la misma planta, en la número 1, Santiago Fuentes también posee una segunda oficina, esta vez para otra compañía de similares características que la anterior, Arbicorp.
Penas por estafas: El abogado Gerardo Pérez Sánchez recuerda que la Ley contempla penas de entre uno y cuatro años de prisión para las llamadas “estafas básicas”. Si la autoridad judicial o el fiscal califican los hechos como una estafa agravada, el acusado o acusados pueden enfrentarse a entre cuatro y ocho años de cárcel. En el supuesto de que se estime que se ha producido un delito continuado en el tiempo, la privación de libertad puede ser todavía mayor.
Sin intermediarios: Puede haber ingresos de 5.000, 20.000 o 30.000 euros, pero también cantidades mucho mayores. El asesor económico y financiero Jorge Hogdson explica que “la gran peculiaridad de esta moneda virtual es la descentralización. Su valor y producción se basan en la ley de la oferta y la demanda. Como no hay intermediarios, las transacciones se efectúan directamente entre personas de cualquier parte del mundo. “Las operaciones son irreversibles, es decir, una vez que se han hecho, no se pueden anular”, señala este experto. Esta moneda virtual no está respaldada por ningún gobierno o banco central; por lo que aún carece de la adecuada seguridad jurídica, apunta. Según Hogdson, de JH Asesores Financieros y Bancarios, en las transacciones “no resulta necesario revelar la identidad y los fondos no pueden ser intervenidos, embargados ni congelados por nadie, lo que atrae, aún más, a la delincuencia organizada”.
